Architectural Additions

The Architectural Committee is concerned with maintaining and enhancing the value of the homes in Diablo View. Changes in the exterior appearance of individual homes must be reviewed by the Architectural Committee. Residents should submit an Architectural Change Request Form to Management prior to making alterations to the exterior appearance of their homes.  Examples of additions and alterations that require prior approval from the Architectural Committee are:

  • Pools
  • Spa
  • Gazebo
  • Hot Tub
  • Shed
  • Trees
  • Play Structures
  • Gates
  • Patio Covers
  • Re-roofing
  • Solar Units
  • Painting
  • Lighting
  • Fencing
  • Hedges

No walls or fences are permitted in the front yards.

Security Doors

Security doors are not allowed in Diablo View. The existence of security doors in a neighborhood causes many people to infer that crime is prevalent in the area. In fact, the area of Martinez that includes Diablo View has one of the lowest crime rates in the city. Security doors discovered during subdivision walk-throughs will be noted, and the homeowners will be directed by written notice to remove the security door at their expense.

Architectural Change Request Form

Painting

The Association requires that homes be maintained in a neat and orderly condition.  The homes were originally painted with Kelly-Moore paint.  Management maintains a list of the original colors.  Please ensure that when it is time to repaint that both you and your attached neighbor are clear as to the color to be repainted. Owners should repaint to match the original colors exactly, not the faded color. Incidentally, the original interior color used was Kelly-Moore "Frost."  You may change the paint color of your home to another color scheme already present within the development. Attached homes require joint Architectural Change Request Forms and agreement to paint.

Architectural Replacements

Garage door replacements may be four or five panel wood or metal roll-up garage doors.  Replacement garage doors must be painted the same color as the original door.

Approved Roofing Products

The Architectural Committee has approved six types of roofing replacement materials for re-roofing homes in Diablo View.  The committee approved several types of products so homeowners would have a choice of materials while maintaining architectural harmony within the subdivision.  The following materials, along with specific brand names where applicable, have been approved.  Addresses of homes where the various products have been installed are included.

Walking Safely on your Steel Roof   Occasionally, you or workers you hire may need to walk on your steel roof. Make sure anyone who needs to walk on your steel roof knows where to step to avoid denting the shakes. Follow the link for the simple instructions.

If you plan to replace your roof, you must submit a request to the Architectural Review Committee prior to commencing with your project.  Although the Committee has reviewed several brands of composition shingles, none have been approved or will be allowed for use in Diablo View.

Antenna Guidelines for Direct-to-Home Satellite Dishes Less than One Meter (39.37") in Diameter, TV Antennas, and Wireless Cable Antennas

Installation:

Homeowners are not required to submit an Architectural Change Request Form when installing a new direct-to-home satellite dish, TV antenna(s) for receiving local stations, or a wireless cable antenna. Instead, please advise Management of the installation by e-mail, fax or telephone prior to its completion, if possible. Otherwise, please submit the requested notification promptly after completion of the installation.

The following installation guidelines are suggested.

The unit should be installed so that it can not hit neighboring property in the event of its accidental detachment from the mounting site. The setback from the fence line should be equal to the height. Cabling should run across the eaves or trim parallel to the structure and not at an angle to minimize its visibility. The cabling should be firmly attached to the structure and not allowed to hang loose. Cabling should enter the building as closely as possible to the antenna location.

The owner agrees to:

  1. Maintain the antenna for appearance and safe working order.
  2. Accept liability for all damages arising from installation or repair of the antenna(s).
  3. Indemnify the Association from any liability or claims, demands, damages, costs or judgments related to the antenna or its installation and obtain any necessary permits from the City of Martinez.

Solar Panel Guidelines

The Davis Sterling Act allows homeowners in Common Interest Developments (CIDs) to install solar energy systems even if the governing documents prohibit them.  The following policy was adopted in compliance with the Act.

Installation:

Homeowners have two options as far as installation is concerned.

  1. The panels must be installed in the rear yard with no portion of the unit exceeding six feet in height from the ground below it.  If it is visible from the street, then it must be painted to match the surrounding landscape.
  2. For any other location, the homeowner must submit a written request to the Architectural Committee prior to commencing with the installation.

Any cabling must be black and run across the eaves or trim parallel to the edge of the structure and not at an angle to minimize exterior visual distraction.  The cabling should be attached to the structure and not allowed to hang loose.

Owner agrees to:

  1. Maintain the panels for appearance and safe working order.
  2. Accept liability for all damages arising from installation or repair of the panel(s).
  3. Indemnify the association from any liability or claims, demands, damages, costs or judgments related to the panel or its installation.
  4. Obtain any necessary permits from the City of Martinez prior to installation.
